The impact of Ellison’s testimony against Bankman-Fried significantly influenced the judge’s decision to show leniency, according to Paul Tuchmann, a former US prosecutor and partner at the law firm Wiggin and Dana.

During Bankman-Fried’s criminal trial in October 2023, Ellison described her former associate as the primary instigator behind the FTX fraud. In her testimony, she characterized Bankman-Fried as forceful and calculating, highlighting his deliberate deceptions, manipulation of his public image, and his risky decision-making approach. Ellison recounted his comfort with high-stakes risk-taking, recalling how he discussed engaging in significant risks like a coin flip that could result in either a substantial loss or a marginal gain.

Ellison became emotional on the witness stand, expressing her guilt over the stolen funds and the relief she felt when FTX began to falter, which meant she no longer had to lie. Her cooperation and personal torment were significant factors in the judge’s leniency. Tuchmann noted the importance of having a close associate of the lead defendant testify, as it provides the jury with an inside perspective.

The judge acknowledged Ellison’s cooperation, remarking on the consistency of her testimony with the material evidence, describing it as unprecedented in his 30 years of experience.

Additionally, the judge took into account the personal cost to Ellison, who faced intense media scrutiny and the public exposure of her private life. Tuchmann highlighted that such consequences can enhance the perceived value of a cooperator’s contributions.

As Ellison prepares for her incarceration, other former FTX executives, Nishad Singh and Gary Wang, await their sentences scheduled for October 30 and November 20, respectively, after pleading guilty to fraud.

Concurrently, Bankman-Fried is seeking a retrial, arguing that he was presumed guilty from the start. Despite these efforts, experts believe the likelihood of overturning the conviction is slim. As the courtroom cleared on Tuesday, Ellison’s family, visibly emotional, was supported by her legal team. Ellison remained stoic, unmoved by the scene around her.
