Epic shared agreement with Google’s standpoint, emphasizing the importance of considering real-world contexts. During Epic’s eight-minute rebuttal to Google’s closing argument, lead attorney Gary Bornstein highlighted the necessity of examining internal documents to understand the situation accurately.
Bornstein advocated for scrutinizing the internal communications, suggesting they reveal the company’s true beliefs and strategies in real-world scenarios. He presented an email previously introduced by Google, which discussed Google’s response to a pricing change by Apple. Despite Apple’s adjustment, Google decided against matching the price change at that time.
He pointed out that Google maintained its pricing strategy even though it recognized Apple’s move, and throughout this period, no developers withdrew from the Google Play Store to concentrate on iOS, according to Bornstein.
